Ion Solutions - Terms of Service

These Terms of Service govern the use of the Ion Solutions website and its services. The term “Ion” is used herein to refer to Ion Solutions. The term “account” herein refers to the access, content, and services that Ion provides to its users.

By activating an Ion account, using an Ion account, and or using Ion’s website, you become a user and you agree to these Terms of Service.

Technical Support

Ion provides technical support by phone from 9am-5pm MST Monday-Friday. Ion provides 24 hour a day technical support by email at support@ionsol.com, and agrees to respond to reasonable requests within 12 business hours.

Ion promotes a mutually-professional relationship with its customers. Abusive, threatening, obscene or otherwise harassing communications with agents of Ion, via telephone, email, online chat or other means will result in immediate account termination not withstanding any other terms of this agreement. Violation of this or any section of this Agreement will result in refund ineligibility.

Cancellations and Billing

Accounts are billed on a schedule set by the account holder at time of account activation, with a default and minimum of one (1) month. Payment due date is fifteen (15) days after billing date. If payment is not received by the due date, a late fee of twenty ($20) dollars or 10% of the balance due, whichever is greater, may be accessed.

Ion has the right to disable or terminate an account for nonpayment, this decision being based on the sole discretion of Ion.

If you should choose to cancel your account after the first day of your billing cycle, you will still be billed for that entire cycle. All accounts are billed in advance (i.e. – if you open an account on January 1st you will pay at that time for the whole month of January)

All cancellations must be received by Ion a minimum of five (5) days prior to the next billing date of the account being cancelled.

The account holder shall be responsible for all fees and charges incurred up to the effective date of cancellation.

Upon receiving notice of cancellation, any outstanding balance becomes due and payable immediately. Any outstanding balance will be immediately billed to the account holders’ primary credit card.

In the event you have elected to prepay for upcoming billing cycles, we retain the right to charge you an administrative fee and deduct the administrative fee from your balance with us, before refunding your balance.

By submitting a credit card or ACH information to Ion, you agree to authorize all recurring charges to the account and any other balances incurred due to overages of limits, additions of extras to the account, service charges and/or any other fees, and to be bound to the terms of this Agreement.

At Ion’s sole discretion you may be charged a reactivation fee of twenty ($20) dollars due to any billing related suspension of your account.

Setup fees are nonrefundable.

Money Back Guarantee

Money back guarantee is not a free trial period, and charges start accruing on the date of account activation. Money back guarantee only applies to basic hosting fees not including domain registration, SSL certificate registration, additional tools purchased, overage fees, or SSL certificate use. Overage fees non-exhaustively include additional databases, disk space, bandwidth, mailing lists, and mailboxes.

Cancellations requested outside the Money Back Guarantee Period are not eligible for a refund in part or in full.

Content

Ion reserves the right to access and review its user’s content, files, or web pages for any reason at its sole discretion. Ion does not preview the content of its users and therefore all user content is provided “as is” and without warranty of any kind by Ion. Ion does not endorse the content contained within it’s user’s pages. Ion will cooperate with all law enforcement efforts pertaining or involving the use of Ion’s user’s web space and content. This cooperation may result in disclosing all information and data Ion has stored for the user in question.

Inappropriate Content

Ion reserves the right to restrict or prohibit any and all uses of the services or content on your website(s) and to remove such material from its servers, which Ion determines in its sole discretion, is harmful to its servers, systems, network, reputations, good will, other Ion customers, or any third party.

Export Violations

Ion does not permit the posting or sending of software or technical information in violation of U.S. export laws, including, without limitation, the Export Administration Act and the Export Administration Regulations maintained by the Department of Commerce.

Harmful Content

A non-exhaustive list includes worms, Trojan horses, time bombs, or any other computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate any system, program, data or personal information.

Fraudulent Conduct

Offering fraudulent goods, services, schemes or promotions, or giving false information on a signup form, contract, application, or registration. Also includes the fraudulent use of any information obtained through the use of the Services. This includes without limitation the illegitimate use of credit card numbers.

Security Violations

Violations of Ion’s or any third party’s server, system or network security are prohibited and may result in criminal and civil liability. Ion reserves the right to investigate incidents involving such violations.

User Name Restrictions

Usernames shall not have any vulgar language. Usernames shall not use a name or organization other than your own. Usernames shall not use a name that is trademarked, copyrighted, service marked, or violates the rights of another individual or organization. You shall not attempt to disguise your self as someone else.

Email Communication

Account holder agrees to maintain a current email address in their profile. Failure to do so could result in the termination of your account. As an account holder you agree to receive updates and newsletters as Ion decides to send them, to the email specified above.

Ion agrees not to send unsolicited promotions, advertising, or solicitations except to those who have explicitly requested such e-mails.

Account Usage

You may not resell or give away Web space under a domain name, nor may you build websites that house "sub domain" websites on behalf of other companies, groups or individuals.

Termination of Service

Ion reserves the right to cancel any account, including files and content, for any reason, or no reason at all, at any time. You agree to maintain back-up files of all information you post on Ion and you agree that Ion will have no liability for removing any data on its’ servers.

The following is a non-exhaustive list of actions which may cause the termination of account:
• Providing links to content that violates these Terms of Service.
• Using an account that is not yours or is inactive.
• Sending unsolicited SPAM from or referencing your space.
• Reproduction or use of another’s content without permission.
• Reproduction of any Ion content.
• Invalid e-mail address in account profile.
• Non-payment of entire balance due by the payment date.

If Ion decides to terminate an account, any outstanding balance becomes due and payable immediately. Any outstanding balance will be immediately billed to the account holders’ primary credit card.

Indemnification of Provider

You agree to indemnify and hold Ion harmless from any lawsuit, claim, charge, or expense, including reasonable attorney fees and costs of defense, for any matter arising from or relating to your website.

This agreement shall be governed by and construed in accordance with the laws of Montana. Should any term be declared invalid by a court with jurisdiction, then the invalid term shall be severable and the remainder of this agreement shall remain in force. This agreement contains the full understanding of the parties with respect to the subject matter hereof. Any communication or correspondence with the account holder which is in any way inconsistent with, or which adds to, the provisions of this agreement is null and void. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.

This agreement is subject to change. A current copy of this agreement will always be located at http://www.ionsol.com/termsofservice.php

Continued usage of an account after a change to this agreement constitutes the account holders acceptance of the revised terms.
